Terms of Use
Using SHAKO
By accessing or using SHAKO, you agree to these Terms of Use. You are responsible for complying with applicable laws and for the activity conducted through your account.
Marketplace role
SHAKO provides a platform that helps vehicle owners, prospective buyers and prospective renters discover each other, share information, and communicate about possible sales or rentals.
Unless SHAKO expressly states otherwise for a particular service, SHAKO is not the buyer, seller, owner, dealer, broker, escrow provider, transporter, insurer, or other party to a vehicle transaction and does not take custody of vehicles or purchase funds.
Listings and seller responsibilities
A person submitting a vehicle represents that they have the right and authority to list it and that the information they provide is accurate to the best of their knowledge. Sellers are responsible for disclosing known material defects, ownership issues, accident or repair history, modifications, and other information that may reasonably affect a buyer's decision.
SHAKO may review, edit, refuse, suspend, unpublish, or remove listings or accounts when reasonably necessary to protect the platform, its users, or third parties, or to enforce these terms.
Offers and transactions
An offer submitted through SHAKO is a communication of purchase interest. Unless the parties separately enter into a binding agreement, an offer displayed on SHAKO does not by itself complete a sale or transfer ownership of a vehicle.
Buyers and sellers are responsible for inspections, payment arrangements, title and registration transfer, taxes, insurance, transportation, delivery, compliance checks, and all other steps necessary to complete a transaction.
Rental marketplace and agreements
SHAKO may allow vehicle owners or authorized operators to advertise rental availability and receive inquiries or booking requests. A listing, availability calendar, request, or message does not itself guarantee a reservation or create a rental contract. Unless expressly stated otherwise, the owner or rental operator and renter are responsible for agreeing on the rental terms, verifying eligibility, arranging handover and payment, and performing their agreement.
Rental laws and operator authorization
Vehicle owners and operators must determine whether their proposed rental activity requires permission, registration, vehicle classification or other compliance under Japanese law, including the Road Transport Act. They must obtain all necessary permissions before offering a rental. Listing a vehicle on SHAKO does not authorize otherwise prohibited commercial vehicle rental activity.
Owner and operator rental duties
The person offering a vehicle for rental must have authority to do so and must provide accurate vehicle descriptions, rates, deposits, mileage restrictions, driver requirements, pickup and return procedures, cancellation rules and any additional charges before a renter commits. They must maintain the vehicle in a roadworthy and legally compliant condition, disclose known safety defects, complete required inspections and maintenance, and provide all documents and equipment required by law.
Renter eligibility and permitted drivers
Renters and every proposed driver must possess a valid license legally recognized for driving the vehicle in Japan, meet the operator's disclosed age and experience requirements, and provide genuine identification or license information when lawfully requested. Only drivers expressly permitted under the rental agreement may drive. Renters must not allow unapproved persons to operate the vehicle.
Insurance, damage and breakdowns
Users must confirm before handover whether appropriate insurance applies to the particular vehicle, rental arrangement, drivers, dates, permitted uses, deductibles and exclusions. SHAKO does not promise that any listing or booking includes insurance, roadside assistance or compensation. The rental agreement should specify responsibility for collision damage, theft, loss, deductibles, loss of use, cleaning, towing, fines and other costs, subject to applicable law. Accidents, theft, breakdowns and unsafe conditions must be reported promptly to the operator and appropriate authorities or insurers as required.
Vehicle use, condition and return
Renters must follow traffic laws and the agreed geographic, mileage, fuel, charging, smoking, pet, passenger, cargo and return conditions. Unless specifically authorized, racing, timed events, circuit use, drifting, off-road use, subleasing, commercial passenger transport and operation while impaired are prohibited. Both parties should document vehicle condition, mileage, fuel or charge level, accessories and any existing damage at pickup and return. Return delays and cleaning or damage claims must follow the disclosed agreement and applicable law.
Rental pricing, cancellations and disputes
Rental prices, taxes, deposits, security holds, mileage or late-return charges, cancellation and no-show rules, and refund eligibility must be clearly disclosed before confirmation. Unless SHAKO explicitly operates a payment or booking service under separate terms, SHAKO does not collect rental payments, hold deposits, provide refunds or arbitrate rental disputes. Users are responsible for keeping records and resolving their agreements, without prejudice to their statutory rights.
Platform safety and enforcement
SHAKO may remove a rental listing, restrict bookings or suspend accounts where it reasonably suspects an unlawful rental operation, misrepresentation, unsafe vehicle, invalid insurance claim, prohibited driving, fraud or risk to users. Such action does not mean SHAKO has inspected, certified, insured or guaranteed any vehicle, operator or renter.
User content
You retain ownership of content you submit. By posting content to SHAKO, you grant SHAKO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, resize, format, and distribute that content as reasonably necessary to operate, promote, and improve the platform.
You must not upload content that you do not have the right to use or content that is unlawful, deceptive, abusive, infringing, or intended to compromise the platform or other users.
Fees
SHAKO may introduce or change fees in the future. Any applicable fee will be disclosed before the user takes the action that creates the charge.
No vehicle or user guarantee
SHAKO does not guarantee the identity, conduct, honesty, creditworthiness, ownership rights, or performance of any user, or the accuracy, completeness, legality, condition, safety, authenticity, or reliability of any vehicle, listing, inspection, communication, or user-provided information.
Users should conduct their own due diligence and obtain professional inspections, legal advice, or other specialist assistance where appropriate before entering into a transaction.
Limitation of liability
To the fullest extent permitted by applicable law, SHAKO and its affiliated brands will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from user-to-user transactions, vehicle condition, payment disputes, transportation, title or registration issues, user content, or reliance on information supplied through the platform.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
Account suspension and termination
SHAKO may restrict, suspend, or terminate access where reasonably necessary because of suspected fraud, abuse, unlawful conduct, security concerns, repeated rule violations, or conduct that threatens the integrity of the marketplace or its users.
Changes to these terms
SHAKO may update these terms as the service evolves. Material changes will be reflected on this page with an updated effective date. Continued use of SHAKO after updated terms take effect constitutes acceptance of the revised terms to the extent permitted by law.
